Sets up a supplementary lease arrangement, allowing the original tenant to engage in subletting, while still being accountable to the landlord.
Required Lease Disclosures
According to the Oklahoma Residential Landlord and Tenant Act, here are the following disclosures a landlord has to make to prospective tenants:
- Disclosure of Flood Hazard Area. Whether the property has experienced flooding within the last five years. [1]
- Notice of Illegal Substance Contamination. Whether the property was a previous site of methamphetamine production. [2]
- Identification. The name and address of anyone with permission to enter the property, including owners and managers. [3]
- Disclosure of Lead-Based Hazards. All Oklahoma landlords of any building constructed before 1978 must notify all tenants of the potential existence of lead-based hazards. [4]
Security Deposit
- Maximum Amount: No limit on how much a landlord may request from a tenant for a security deposit.
- Receipts: Not specified by law.
- Interest Payments: Landlords are not required to pay interest on security deposits.
- Bank Account:Landlords are required to keep any security deposits in a separate escrow bank account that the State of Oklahoma maintains. [5]
- Returning Requirements: A landlord must return any security deposit to the tenant within 45 days of the end of the tenancy. [5]
- Withholding Rules:Landlords can withhold security deposit funds for unpaid rent or damages and must itemize these deductions in a written statement with the remaining deposit. [5]
Rent Payments
- Laws: Rent is due on the date specified in the lease agreement, if not specified, at the beginning of each month. [6]
- Rent Control: Banned. [7]
- Late Fees and Grace Period: No maximum late fee or grace period, but a 5-day notice to pay rent or quit is required before starting eviction.
- Withholding Rules:If a landlord’s noncompliance affects health and repairs cost less than one month’s rent, the tenant can notify the landlord of their intention to make the repairs at the landlord’s expense. If the landlord doesn’t address the issue in 14 days, the tenant may arrange the repair and deduct the cost from the rent. If essential services like heat or water are missing, the tenant can notify the landlord and either terminate the lease, obtain the services and deduct the cost, recover damages, or find alternate housing. Landlord Right of Entry
- Notice Requirements: Oklahoma landlords are required to give tenants one day’s notice before entering the premises. This includes entry for maintenance and repair purposes, and the landlord must only enter at reasonable times. In cases of emergency, landlords are allowed to enter the premises without giving a tenant advanced notice. [9]
- Keys, Locks, and Security: If specified in the lease, Tenants may change the locks
Property Repairs
- Landlord Responsibilities: Landlords must ensure rental units are habitable by maintaining health and safety standards and promptly addressing repair requests.
- Tenant Repairs:The landlord may issue a 15-day notice to vacate if the tenant fails to maintain utilities unless the issue is fixed within 10 days. [10]
- Abandonment: No state-mandated length of time.
Terminating a Lease
- Month-to-Month Tenancy: Can be terminated by providing a 30-day notice.
- Unclaimed Property:If a tenant leaves valuable personal property behind, the landlord must store it for 30 days and notify the tenant that it will be considered abandoned after this period. [11]
